Servitek FOUSSIER operates in the technical supply sector for the building and industrial markets. We distribute products from various suppliers and also design and manufacture certain product lines included in our catalog.

1.2 – Customers

A customer is defined as the legal entity or individual purchasing products from Servitek FOUSSIER. By placing an order, the customer acknowledges being bound by a payment obligation. These general terms and conditions of sale apply to all customers without exception.

2. Prices and Taxes

2.1 – Prices indicated are net prices, ex works (excluding delivery costs), and exclude all additional charges (customs duties, taxes, etc.). Confirmed prices are valid only for the specified quantity, until the offer’s validity date, and for deliveries made within 30 days following the order date.

2.2 – Prices displayed on our website are deemed current and constitute the sole reference prices. Depending on the order conditions, invoicing, packaging, transportation, and additional fees may apply.

2.3 – Unless otherwise agreed in advance, prices quoted in our estimates are valid for a period of one month.

2.4 – Prices are reviewed annually to reflect cost variations. In the event of significant changes in raw material costs, exchange rates, or transportation conditions, price adjustments may be applied in a transparent and fair manner.

2.5 – For sales within Canada, products are subject to GST, PST, or HST, depending on the delivery location.

2.6 – For sales outside Canada, products are subject to applicable import taxes in the destination country.

2.7 – Any tax imposed by a governmental authority resulting in additional transaction costs shall be borne by the customer.

3. Orders

3.1 – An order is considered effective only once the customer receives an order confirmation by email.

3.2 – Delivery times are indicative and may vary due to external conditions or force majeure events (strikes, machinery breakdowns, supplier disruptions, etc.).

3.3 – The minimum amount for a quotation request is $100 before taxes. No minimum amount is required for online orders.

3.4 – For orders expressed in length or weight units, a tolerance of ±10% may apply. Billing will reflect the actual quantity delivered.

4. Payment

4.1 – Payments by credit card, debit card, and bank transfer are accepted. For a first order, full payment is required prior to shipment. For subsequent orders, a payment term of up to 30 days may be granted following a creditworthiness review.

4.2 – In the event of non-payment persisting more than 10 days after written notice, Servitek FOUSSIER may suspend deliveries and apply interest at a rate of 5% above the Canadian prime rate.

4.3 – Delivered products remain the property of Servitek FOUSSIER until full payment of all outstanding amounts.

4.4 – Any credit note issued is valid for a period of one year.

4.5 – For customers located in Quebec, Servitek FOUSSIER reserves the right to invoke the legal construction lien applicable to builders and material suppliers.

5. Delivery

5.1 – Deliveries are made to the address provided by the customer. Any change may result in an extended delivery time.

5.2 – Delivery dates are indicative only. Any claims related to transportation damage or delays must be addressed directly to the carrier.

5.3 – In the event of delivery refusal without prior agreement, products may be invoiced and stored at the customer’s expense.

5.4 – Delivery costs are borne by the customer but may be negotiated depending on order volume and value.

5.5 – Additional delivery charges may apply for oversized, heavy, or non-standard items.

6. Return and Refund Policy

6.1 – No merchandise may be returned without an order number. Returns must be made within 30 days. After 30 days, refunds are limited to 50%, and after 60 days, no refund will be issued.

6.2 – Products must be new, complete, and in their original unopened packaging. Custom-made products are non-refundable.

6.3 – A 15% handling fee applies to all returned merchandise.

7. Warranty

7.1 – All products are covered by the tekCARE warranty, subject to proper use.

7.2 – The warranty does not cover labor costs. Repair or replacement is at the sole discretion of Servitek FOUSSIER.

7.3 – Improper installation voids the tekCARE warranty.

8. Confidentiality

8.1 – Servitek FOUSSIER complies with Quebec Law 25 and Canada’s PIPEDA legislation.

8.2 – Data protection is the responsibility of the IT management team.

8.3 – Customer data is used solely for order processing purposes.

8.4 – Any complaint must be submitted to the company prior to initiating legal action.

9. Governing Law

These terms and conditions are governed by the laws of Quebec and Canada.

10. Updates

10.1 – Servitek FOUSSIER reserves the right to modify these terms at any time.

10.2 – If any provision is deemed invalid, the remaining provisions shall remain fully enforceable.
